By accessing or using SmartHood ("Service", "Extension", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

SmartHood is a Chrome browser extension that provides AI-powered informational property research and neighborhood insights for real estate listings on platforms including Zillow and Funda.

SmartHood is an informational research tool designed to help users organize and understand property and neighborhood data. It does NOT provide financial advice, investment advice, real estate brokerage services, or professional recommendations. All information is provided for educational and informational purposes only. Users are solely responsible for their own decisions and should consult qualified professionals before making any real estate or financial decisions.

2. Description of Service

SmartHood provides the following informational features:

  • Property Research: AI-generated informational summaries of real estate listings
  • Neighborhood Data: Educational information about neighborhood safety, schools, and lifestyle factors
  • Lifestyle Information: Informational scoring based on various neighborhood factors for research purposes
  • Nearby Amenities: Data about medical facilities, dining, transit, and other nearby places
  • Cost Estimates: AI-generated approximate cost estimates (for informational purposes only, not professional appraisals)
  • Data Analysis: Property data visualization and informational context
  • Comparison Tools: Side-by-side data comparison of multiple properties
  • AI Summaries: AI-generated educational insights and contextual information

The Service integrates with third-party platforms (Zillow, Funda, Google Maps) and uses OpenAI technology to provide these features.

3. User Accounts and Authentication

3.1 Account Creation

  • Users must create an account using valid email credentials through our authentication provider (Clerk)
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information during registration
  • You must be at least 18 years old to use this Service

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4.2 Payment Processing

  • Subscription pricing is displayed at https://www.usesmarthood.app/upgrade
  • Prices are subject to change with 30 days notice to existing subscribers
  • All fees are in USD unless otherwise specified
  • Payment processing is handled securely through our third-party payment processor

4.3 Billing

  • Subscriptions are billed on a recurring monthly basis
  • You authorize us to charge your payment method on each billing cycle
  • Failed payments may result in service suspension
  • You are responsible for all applicable taxes
  • Our payment processor handles all payment processing, tax calculation, and invoicing

4.4 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods unless otherwise specified

5. Refund Policy

5.1 30-Day Money-Back Guarantee

  • First-time subscribers are eligible for a full refund within 30 days of initial purchase
  • To request a refund, contact us at support@usesmarthood.app
  • Refunds are processed within 5-10 business days to the original payment method

5.2 Refund Eligibility

You are eligible for a refund if:

  • You are within 30 days of your first subscription purchase
  • You have not previously received a refund for SmartHood
  • You have not violated these Terms of Service

You are NOT eligible for a refund if:

  • More than 30 days have passed since your initial purchase
  • You are on a renewal subscription (refunds apply only to first purchase)
  • Your account has been terminated for Terms violations
  • You have previously received a refund
  • You purchased through a third-party reseller

5.3 Refund Process

  1. Email support@usesmarthood.app with subject "Refund Request"
  2. Include your account email and reason for refund (optional)
  3. We will process your refund within 5-10 business days
  4. Confirmation will be sent to your registered email

5.4 Partial Refunds

  • We do not offer partial refunds for unused time
  • Annual subscriptions cancelled mid-year are not eligible for pro-rated refunds after the 30-day window
  • Promotional pricing or discounts are not refundable separately

5.5 Exceptional Circumstances

  • Refunds outside the 30-day window may be considered on a case-by-case basis for technical issues
  • Service outages lasting more than 48 consecutive hours may qualify for service credits

6. Acceptable Use Policy

6.1 Permitted Use

You may use SmartHood for:

  • Personal real estate research and property evaluation
  • Professional real estate analysis (agents, investors)
  • Educational purposes related to real estate and property markets

6.2 Prohibited Use

You may NOT:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or disassemble the Extension
  • Use automated tools (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Resell or redistribute Service data without permission
  • Interfere with or disrupt the Service or servers
  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for competing products or services

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

7.2 No Professional Advice

  • SmartHood provides informational insights only
  • The Service does NOT constitute professional real estate, financial, legal, or investment advice
  • Always consult qualified professionals before making real estate decisions
  • We are not licensed real estate brokers, appraisers, or financial advisors

7.3 Data Accuracy

  • AI-generated insights and estimates are approximations only
  • Property valuations, renovation estimates, and cost calculations may be inaccurate
  • Always verify all information independently before making decisions
  • We are not liable for decisions made based on Service data

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
